By using Happy Grove's services, you ("Client") agree to the following Terms and Conditions. Please read these terms carefully before booking any services through our website or contacting us for a consultation.

Scope of Services
The services provided by Happy Grove include:

Outdoor Watering: Watering garden beds, plants, lawns, containers, and raised beds.

Indoor House Plant Watering: Watering indoor plants, including but not limited to house plants, potted plants, and other specified indoor plants.

Replanting Services: Removal of a plant from its existing pot, evaluation of root health, and transfer into a new or cleaned existing container with fresh, appropriate soil. Includes optional trimming of dead roots or foliage and basic aftercare recommendations. The Client may provide pots or purchase them from Happy Grove.

Plant Arrangements & Styling: Custom design and arrangement of plant displays for indoor or outdoor spaces, using client-supplied or Happy Grove-provided pots and plants.

Plant Rescue & Maintenance: Diagnosis and treatment for stressed or unhealthy plants, including pest inspection, repotting, pruning, and care recommendations.

Additional Services: As agreed upon during booking, including consultations, seasonal adjustments, garden styling, and emergency plant care services.

Service Agreement
By booking a service on our website or contacting us for a consultation, you acknowledge and agree to the following:

Service Fees: The Client agrees to pay the service fees as outlined on the website or discussed during the consultation. Fees are subject to change based on garden size, service frequency, and plant types.

Deposit Requirement: A deposit of the total service fee is required at the time of booking. This deposit is non-refundable and will be applied toward the total cost. The remaining balance is due upon completion of the service.

Payment: Payment is due according to the agreed-upon schedule. Options may include online payments, bank transfer, or credit card. Late payments may incur a fee.

Access to Property

Property Access: The Client grants Happy Grove access to the property to perform services. The Client agrees to provide any necessary access codes, keys, or lockbox details. We respect your privacy and will only enter designated areas.

Indoor Access: For indoor services, the Client must ensure accessible entry to the areas where plants are located.

Scheduling and Frequency of Services

Scheduling: The Client agrees to coordinate a schedule with Happy Grove. Services may be weekly, bi-weekly, or custom.

Changes to Schedule: Clients must provide at least 24 hours' notice for rescheduling. Happy Grove will notify Clients if we must adjust schedules due to weather or emergencies.

Responsibilities of the Client

Access and Availability: The Client must ensure clear access to all areas requiring service.

Communication: Clients should communicate any special instructions, preferences, or changes in plant health promptly.

Payment and Refunds

Refund Policy: No refunds will be issued unless Happy Grove fails to deliver the agreed service. Cancellations within 24 hours may incur a fee. For prepaid or multi-visit packages, partial refunds may be issued for unused portions if the service is canceled in advance with proper notice, subject to an administrative fee. All refund decisions will be made at the discretion of Happy Grove based on services rendered and notice provided. unless Happy Grove fails to deliver the agreed service. Cancellations within 24 hours may incur a fee.

Late Fees: Payments not received within 5 days of the due date may incur a 10% late fee.

Termination of Services
Happy Grove may suspend or terminate services for:

Non-payment

Inaccessibility of the property

Failure to follow scheduling requirements
Either party may terminate service with 24 hours’ written notice.

Limitation of Liability
Happy Grove is not liable for damages due to:

Weather, pests, or pre-existing plant conditions

Property or plant issues not caused by our negligence

Transplant shock or plant stress following replanting
-
Force Majeure
Neither party is liable for service interruptions due to causes beyond their control, including natural disasters, emergencies, or governmental restrictions. -
Intellectual Property
All trademarks, service marks, logos, and content provided by Happy Grove are the intellectual property of Happy Grove or its licensors and are protected under applicable copyright and trademark laws. Unauthorized use is prohibited. -
Disclaimers
All services are provided "as is" without warranties of any kind, either express or implied. Happy Grove does not guarantee plant health outcomes due to environmental factors outside of our control. -
Governing Law
This Agreement is governed by the laws of the State of Illinois. -
Dispute Resolution
Any disputes arising from or related to these Terms shall be resolved through binding arbitration in Illinois under the rules of the American Arbitration Association. However, either party may elect to bring an individual claim in small claims court if it qualifies. Prior to initiating arbitration, both parties agree to attempt informal resolution through a good faith mediation process, which must be initiated within 30 days of the dispute arising. to these Terms shall be resolved through binding arbitration in Illinois under the rules of the American Arbitration Association. -

Happy Grove values Client privacy. We do not share personal or property-related information without consent, unless required by law. Please refer to our Privacy Policy for further details.
